General conditions of sale

Preamble
These general terms and conditions of sale govern all sales contracts for products belonging to SAS SASSY France, whose head office is at MANNEVILLE LA PIPARD (14130) Clos Noirval, Haras de Noirval, registered with the RCS of LISIEUX under number 797 839 578 and its customers. Unique Identifier (IDU) for the household packaging sector: FR404691_01CPHT

The customer acknowledges having read the general conditions of sale set out below. Placing an order online automatically implies your acceptance of our general conditions of sale.

In the event of non-compliance with these conditions by the buyer, SASSY France reserves the right to cancel all or part of current orders or to suspend deliveries of goods.

Article 1: Applicable law
The company having its registered office in France, the law applicable to any sales contract is French law.

Article 2: Fields of application
These conditions apply to the sale of products by the company SASSY France via the website www.maison-sassy.com.

Consequently, placing an order implies the buyer's full and unreserved acceptance of these "general conditions of sale", to the exclusion of all other documents such as prospectuses, press releases, catalogues or e-mails issued by the seller, which have only an indicative value.

All clauses and conditions contrary to these General Conditions of Sale appearing on the purchase orders and more generally on any type of correspondence emanating from the buyer will be deemed unwritten and will have no contractual value between the parties. These General Conditions of Sale may only be waived by express written agreement of SASSY France.

The information contained in SASSY France catalogues, prospectuses, advertisements, notices or other documents is given for information purposes only and is not binding on the company, which may modify it at any time.

The photographs of the products are given for illustration purposes only, it is possible that the product differs from what is displayed. The information provided by the photographs does not bind SASSY France, which may modify them at any time.

SASSY France reserves the right to correct any accidental material error or omission in these Conditions, as well as in any other contractual document.

Article 3: Legal information
Article L 3342-1 of the Public Health Code stipulates that the sale of alcohol to minors under the age of eighteen (18) is prohibited. The Buyer undertakes, by completing the order form, to be eighteen years of age or older on the date of the order.

To this end, the site www.maison-sassy.com has been declared to the National Commission for Information Technology and Civil Liberties.

Alcohol abuse is dangerous for your health. Consume in moderation.

Article 4: The online store - order
All orders must be placed through the Online Store: www.maison-sassy.com

The commercial offer of the SASSY France company covers all the products presented in the Online Store catalog. The online store mentions the essential characteristics of each product, its price, and the amount of delivery costs.

The order is confirmed by SASSY France by sending an email to the buyer.

Article 5: Validity of the order
SASSY France reserves the right to refuse any order for legitimate reasons and more particularly in the case where the quantities ordered, by means of one or more orders, are abnormally high compared to the quantities usually ordered by buyers as consumers.

Article 6: Availability of stocks:
Products are delivered within the limits of available stocks.

In the event of unavailability of the ordered product or a delay in delivery, the company must reimburse the customer within 14 days of the refund request.

The customer may, if he wishes, obtain an equivalent product instead of the product ordered.

Article 7: Price
The prices of our products are in euros, all taxes included, excluding shipping costs.

The buyer is bound by an obligation to pay the price at the time of ordering on the Online Store.

The prices charged for the products are those appearing on the Online Store on the date of confirmation of the order by the buyer.

SASSY France reserves the right to modify the prices in force on the Online Store at any time. The price change will be automatically applicable on the date of publication of the price modification on the Online Store.

All orders, regardless of their origin, are payable exclusively in Euros.

Shipping costs, customs taxes and formalities are the sole responsibility of the customer.

Article 8: Payment
Payment for products is made in full when ordering, either:

by transfer to our bank account with the following references: FR76 11 42 5009 0008 0034 2078 908 (IBAN).
through the Stripe payment platform.
SASSY France reserves the right to modify the payment methods available at any time.

For any order over €500 in France and €250 in Europe, you will be asked to make payment by bank transfer, informing the bank that the transfer has been made.

In accordance with the provisions of Article L 441-6 of the French Commercial Code, in its version in force on 1 January 2013, any amount not paid within thirty days following the due date is increased by the legal interest rate plus three points. Late payment penalties are payable without any reminder being necessary. A fixed compensation of €40, as set by Decree No. 2012-115 of 2 October 2012, will be due for recovery costs in the event of late payment.

Article 9: Delivery and shipping terms
The ordered products are delivered to the address indicated by the customer. The package will be sent to the recipient via a service provider of our choice.

All orders are processed by the online customer service of SASSY France and shipped from Monday to Friday inclusive, except public holidays.

Shipping times are on average 2 to 3 working days. It may be extended during periods of high activity or in the event of exceptional closure. The delivery time will be a maximum of 30 days. Beyond this, the customer is entitled to claim a refund within 14 days of the claim.

It is expressly agreed that the buyer becomes responsible for the products upon delivery, the transfer of possession constituting transfer of risk.

Article 10: Reservation of ownership
SASSY France retains full ownership of the products until full payment of their price, principal and interest, by the buyer.

Until they have been paid in full, the buyer undertakes not to resell the unpaid products, not to dispose of them and to take all measures to ensure that these products are kept in the condition in which they were delivered and that they remain individualized as the property of the company.

Article 11: Circumstances of release
SASSY France is released from its obligations by the occurrence of events constituting force majeure, unforeseeable circumstances or acts of God.

In this respect, the following events are considered cases of force majeure or fortuitous events:

fire, flood or any other accident causing the complete or partial destruction of the stocks and supplies of SASSY France;
the strike, the lockout without it being necessary to seek out by whose actions the movement originated;
the occurrence of a natural disaster, a war, a pandemic episode;
lack of motive power or raw materials resulting from a general cause, such as in particular the stoppage of transport, interruption of electrical power, machine breakdown;
any cause of disruption in supply attributable to the suppliers of SASSY France.
The sales contract binding SASSY France to the buyer is then automatically suspended, without compensation, from the date of occurrence of the event.

Article 12: Buyer's right of withdrawal
Exercising the right of withdrawal
The buyer has a period of fourteen (14) days following receipt of the order to exercise his right of withdrawal, without having to provide a reason.

To exercise his right of withdrawal, the buyer must notify his decision by means of a clear and precise statement free from any ambiguity.

The buyer's withdrawal declaration must include the following mandatory information: buyer's name, geographical address and, where applicable, telephone number, fax number and email address. In the event that the product was received by a third party other than the buyer, the latter must indicate the contact details of this third party in the withdrawal declaration.

The declaration may be made by any means at the company's headquarters.

Upon receipt, SASSY France will immediately send the buyer an acknowledgement of receipt of the withdrawal on a durable medium.

The buyer cannot exercise his right of withdrawal if the goods in question have been made to the buyer's specifications or are clearly personalized or which, due to their nature, cannot be returned or are likely to deteriorate or expire rapidly.

The right of withdrawal cannot be exercised for products which have been unsealed or opened by the buyer or the recipient of the order after their delivery.

Effect of withdrawal
In the event of withdrawal at the initiative of the buyer, SASSY France will reimburse the buyer for all sums paid, no later than fourteen (14) days from receipt by it of the buyer's decision to withdraw, in accordance with the provisions of article 12a) above.

The buyer undertakes to return the products received without delay, if applicable no later than fourteen (14) days from notification of the declaration to SASSY France. The withdrawal will only be effective after the products have been returned to SASSY France before the expiry of the period of fourteen (14) days.

The cost of returning the products is the responsibility of the buyer. These costs vary with the weight of the package, and are estimated at a maximum of approximately 50 EUR in Metropolitan France. The company cannot be held responsible for the inaccuracy of the estimate of shipping costs.

Buyer's Responsibility
The buyer is liable for any depreciation of the product or its packaging.

Article 13: Product warranty
The products sold materially correspond to the specifications presented to the buyer by the Online Store when used in strict compliance with the functions for which they were sold.

Unless otherwise provided by law, the liability of SASSY France may not under any circumstances exceed the amount of the value of the goods invoiced.

In any event, the customer benefits from the legal guarantee of conformity, the legal guarantee of eviction and hidden defects (article 1625 et seq. of the Civil Code) on condition that the buyer proves the hidden defect, the seller must legally repair all the consequences (article 1641 et seq. of the Civil Code); if the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect.

As a result, the buyer has up to 3 months from the delivery date to send his complaint to SASSY France. Beyond this period, we will no longer be able to guarantee the disputed product since no control over the quality of the storage location can be carried out, or the buyer will have to provide proof that the alteration of the product is prior to the sale.

Article 14: Personal data and confidentiality charter
In accordance with the French Data Protection Act of 6 January 1978, as amended by the Act of 6 August 2004, the collection and processing of the buyer's personal data via the website www.maison-sassy.com has been declared to the French National Commission for Data Protection and Liberties (declaration number 1797740).

The buyer has a general right of access, modification, rectification and deletion of his personal data.

Article 15: Electronic signature
The "OK" associated with the authentication and non-repudiation procedure and the protection of the integrity of messages, constitute an electronic signature. This electronic signature has the value, between the parties, of a handwritten signature.

Article 16: Absence of tacit waiver
The fact by one of the Parties, at any time whatsoever, of not exercising a prerogative granted to it by these General Conditions of Sale, in particular of not proceeding with the termination of the sales contract or of exercising this prerogative late, or of not requiring the execution of any stipulation of the General Conditions of Sale, may not under any circumstances be interpreted as an express or tacit waiver by this Party, neither of the right to exercise said prerogative in the future, nor of its right to require the scrupulous execution of the commitments entered into by the other Party to undertake any action or claim which it may have in relation to the non-performance of its obligations by the other Party, nor possibly of its right to terminate this contract for any violation of the same or a different nature.

Article 17: Intellectual property rights
The SASSY brand is registered under number 013262761. Any reproduction or imitation will be prosecuted as a counterfeiting offence.

The site www.maison-sassy.com and each of the elements that compose it (such as registered trademarks, domain names, texts, tree structures, software animations, images, photographs, illustrations, packaging, diagrams, logos, sounds and music) are the exclusive property of the company SASSY France or of third parties who have duly authorized by it to exploit these elements, which is the only one authorized to exploit the related intellectual property rights.

No element of the site may be used, reproduced, distributed or published in whole or in part without written authorization from SASSY France.

The use of all or part of the SASSY France site, in particular by downloading, reproduction, transmission, representation or distribution for purposes other than your personal and private use for non-commercial purposes is strictly prohibited.

Article 18: Hyperlinks and comments
The creation of hypertext links to the site www.maison-sassy.com is subject to the prior written authorization of SASSY France, which may be revoked at any time.

SASSY France declines all responsibility (in particular editorial) concerning access to the sites – and their content having a hypertext link to or on the site www.maison-sassy.com

SASSY France reserves the right to delete any comment published by an Internet user and/or a buyer on the site www.maison-sassy.com

Article 19: Access to the online store
SASSY France reserves the right to make changes to the Online Store and the website www.maison-sassy.com at any time and without notice.

SASSY France declines all responsibility in the event of interruption or inaccessibility of the site www.maison-sassy.com, occurrence of bugs, or any damage resulting from fraudulent acts on the part of third parties (in particular by intrusion) from the site www.maison-sassy.com.

Article 20: Applicable law – competent jurisdictions
These general conditions are exclusively governed by French law, to the exclusion of any other law, in particular arising from the Vienna Convention of April 11, 1980 on the international sale of goods.
